Welcome to Red Magic Storage
This Rental Agreement ("Agreement") is between Red Magic Boat & RV Storage, LLC ("Red Magic," "we," or "us") and the customer identified below ("you"). It covers outdoor storage of an RV, boat, trailer, or other approved recreational or utility vehicle at 2701 Pine Street, Yankton, SD 57078.
By checking the acknowledgment box at the end and completing checkout, you confirm that the information in your account is accurate and that you agree to this Agreement and to the Red Magic Storage Facility Rules.

Reservation and start of billing. You are reserving the space identified above. Your space is held for you once your deposit is received. Recurring billing for your plan begins when the facility opens. This Agreement continues on the basis described under "Billing" above and renews automatically for successive terms of the same length unless you cancel before a renewal or this Agreement is otherwise ended.
Founders Program deposit. The deposit shown above is fully refundable at your request at any time until the facility's opening day. If you do not request a refund, the deposit is applied to your first period's rent after the facility opens. To request a refund before opening day, contact info@redmagicstorage.com; refunds are returned to your original payment method. If you cancel your reservation before opening day, your deposit is refunded in full. After the facility opens and billing begins, the deposit has been applied to rent and the ordinary cancellation and refund terms of this Agreement apply.
Rate lock (Founders Program). If your plan includes a founding-member rate lock, your base rental rate will not increase for thirty-six (36) months from the facility's opening date (currently scheduled for October 1, 2026), provided your account remains in good standing. Rate-lock eligibility is limited to the number of founding members Red Magic designates and is applied in the order reservations are completed. Taxes and any government-imposed or pass-through charges are not part of the locked rate.
Autopay authorization. You authorize Red Magic and its payment processor, Stripe, to charge the payment method you provide at checkout for the deposit shown above and, once billing begins, for the recurring rent and any other amounts due under this Agreement, until you cancel as described here. You can update your payment method from your dashboard.
Rate changes. Except during any period in which your rate is locked, Red Magic may change rental rates or fees by giving you reasonable advance notice. If you do not agree to a change, you may end this Agreement before the change takes effect by removing your property and following the move-out steps.
Ending this Agreement. You may end this Agreement by giving Red Magic notice, removing all of your property from the space, leaving the space clean, and paying any amounts owed through your final period. Prepaid rent is non-refundable except as expressly stated in this Agreement or required by law.
Section 2 — Insurance
Red Magic Storage does not provide insurance for your RV, boat, trailer, vehicle, equipment, or personal property. You are responsible for maintaining appropriate insurance coverage. You may be asked to provide proof of insurance.
Section 3 — Nature of the storage
Red Magic Storage provides outdoor storage space only. Red Magic does not take possession, custody, or control of your property. Your stored property remains under your ownership and responsibility at all times.
Outdoor storage may expose property to risks including wind, rain, snow and ice, hail, fire, flooding or drainage conditions, falling trees or branches, animals or pests, theft, vandalism, vehicle collisions, acts of third parties, and other natural or unforeseen events. Security cameras, fencing, gates, locks, lighting, and other measures are intended to help deter unauthorized activity but cannot guarantee against theft, vandalism, damage, or loss.
Section 4 — Your responsibilities
You agree to:
- keep your contact and payment information current;
- maintain required registration and licensing;
- maintain appropriate insurance coverage;
- keep your stored property in reasonably safe condition;
- properly secure doors, windows, awnings, hitches, covers, jacks, and other equipment;
- promptly notify Red Magic of leaks, damage, or unsafe conditions;
- keep your assigned space clean and free of trash or debris;
- drive carefully while on Red Magic property; and
- be responsible for guests or other individuals you allow onto the property.
Section 5 — Prohibited activities
Unless Red Magic provides written approval, the following are not permitted: living or sleeping overnight in stored property; camping; operating a business from the facility; major mechanical repairs; welding, painting, body work, or similar repairs; washing vehicles or equipment; dumping sewage or wastewater; discharging oil, fuel, antifreeze, chemicals, or other substances; storing hazardous or illegal materials; storing explosives or fireworks; leaving garbage or loose materials outside stored property; blocking driveways, gates, neighboring spaces, or emergency access areas; and subleasing or transferring your space to another person without authorization.
Section 6 — Fuel, propane, and batteries
Normal quantities of gasoline, diesel fuel, or propane contained within permanently installed systems of the stored property are permitted. You are responsible for maintaining fuel systems, propane systems, batteries, and related equipment in safe condition. Portable fuel containers, additional propane cylinders, and unusually large quantities of flammable materials may not be stored without approval.
Section 7 — Access and security
You may access Red Magic Storage during established access hours. If you receive a gate code, key, credential, or other means of entry, you agree not to share it with unauthorized persons and to ensure the gate closes properly after you enter or leave. Red Magic may temporarily restrict access when reasonably necessary because of severe weather, maintenance, safety concerns, security issues, emergencies, or other operational conditions.
Section 8 — Damage and liability
You are responsible for damage you cause to gates, fencing, signs, buildings, landscaping, other stored property, or other portions of the Red Magic facility, and you must promptly report accidents or damage. To the fullest extent permitted by law, Red Magic Storage is not responsible for loss or damage resulting from theft, vandalism, weather, fire, acts of nature, acts of third parties, mechanical failure, or circumstances beyond Red Magic's reasonable control. Nothing in this Agreement is intended to waive liability that cannot legally be waived.
Section 9 — Payment default and abandoned property
Failure to pay amounts due or to materially comply with this Agreement may place you in default. If you default, Red Magic may exercise the remedies available under this Agreement and applicable South Dakota law. Any restriction of access, lien enforcement, towing, removal, sale, or disposal of property will be handled in accordance with applicable law. You may not abandon property at the facility and may be responsible for lawful towing, removal, storage, legal, or collection expenses associated with abandoned property or default.
Section 10 — Facility Rules
You agree to follow the current Red Magic Storage Facility Rules, including rules concerning gate access, speed limits, parking, safety, snow removal, waste disposal, property maintenance, security, and emergency procedures. Red Magic may reasonably update the Facility Rules as operational needs change and will provide reasonable advance notice of material changes.
Section 11 — Communication consent
Red Magic may communicate with you about billing, facility access, weather or emergency conditions, security issues, your stored property, and changes to facility rules, rates, or policies, through email, telephone, text message, mail, or other legally permitted methods. These are service communications related to your rental.
Section 12 — General
This Agreement, together with the Facility Rules, the Terms & Conditions, and the Privacy Policy, is the entire agreement between you and Red Magic regarding your storage rental. It is governed by South Dakota law, and any dispute will be brought in the state or federal courts located in or serving Yankton County, South Dakota. If any provision is unenforceable, the rest remains in effect. Red Magic may assign this Agreement in connection with a sale or transfer of the facility.
You agree that checking the acknowledgment box below and completing checkout has the same effect as your handwritten signature and shows your acceptance of this Agreement.
