1. Acceptance of these terms

These Terms & Conditions ("Terms") govern your access to and use of the website at redmagicstorage.com and any related pages, features, and online services (the "Site"). By using the Site or creating an account, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Site.

These Terms cover your use of the Site. Your storage rental itself is governed by the Red Magic Storage Rental Agreement and the Red Magic Storage Facility Rules, which you accept during checkout. If there is a conflict between these Terms and the Rental Agreement or Facility Rules regarding your storage rental, the Rental Agreement and Facility Rules control.

2. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Site or reserve a storage space. You agree to provide accurate, current, and complete information and to keep it up to date.

3. Accounts

You are responsible for the activity that occurs under your account and for keeping your login credentials and any facility access credentials confidential. Notify us promptly at info@redmagicstorage.com if you believe your account or access credentials have been compromised. We may suspend or terminate an account that we reasonably believe has been used in violation of these Terms, the Rental Agreement, or the Facility Rules, or to protect the Site, our customers, or the facility.

4. Reservations, plans, and pricing

The Site lets you reserve a storage space, select a plan, and manage your rental. Reserving a space online does not by itself create a storage rental; a rental begins when you complete checkout, accept the Rental Agreement and Facility Rules, and your payment or deposit is received.

Prices, plans, fees, deposit amounts, and space availability shown on the Site may change at any time before you complete checkout. Once you complete checkout, the price and terms for your rental are those stated in your Rental Agreement, including any rate-lock or founding-member terms described there. Except where a plan expressly locks your rate for a stated period, rental rates and fees may be adjusted with reasonable advance notice as described in the Rental Agreement.

At the time of this Effective date, the facility is preparing to open. Reservations made before opening secure a space and, where applicable, a refundable deposit; recurring billing for your plan begins when the facility opens, as described at checkout and in your Rental Agreement.

5. Payments

Payments, deposits, and recurring billing are processed by Stripe. By providing a payment method, you authorize us and Stripe to charge that method for the amounts due under your selected plan and Rental Agreement, including recurring charges, until you cancel in accordance with the Rental Agreement. A platform service fee may be added to transactions and is shown before you pay. Refunds, including deposit refunds, are handled as described in the Rental Agreement.

6. Acceptable use

You agree not to:

  • use the Site for any unlawful, fraudulent, or unauthorized purpose;
  • provide false information or impersonate another person;
  • attempt to gain unauthorized access to the Site, other users' accounts, or our systems or those of our providers;
  • interfere with or disrupt the Site, including by introducing malware or placing an unreasonable load on our infrastructure;
  • scrape, harvest, or copy content or data from the Site except as expressly permitted; or
  • use the Site to infringe the rights of others.

7. Intellectual property

The Site and its content — including text, graphics, logos, layout, and software — are owned by Red Magic Storage or its licensors and are protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for the purpose of reserving and managing your storage rental. All other rights are reserved. "Red Magic Storage" and associated names and logos may not be used without our prior written permission.

8. Third-party services

The Site relies on third-party services, including Stripe, Supabase, Vercel, and Resend, and may link to third-party websites. We are not responsible for the content, policies, or practices of third parties. Your use of Stripe's payment services is also subject to Stripe's terms and privacy policy.

9. Disclaimers

The Site is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, and we do not warrant that the Site will be uninterrupted, timely, secure, or error-free, or that information on the Site is accurate or complete.

Nothing in this section limits any rights you have under the Rental Agreement or any warranty or liability that cannot be disclaimed under applicable law.

10. Limitation of liability

To the fullest extent permitted by law, Red Magic Storage and its members, managers, employees, and service providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or business interruption, arising out of or relating to your use of the Site, even if we have been advised of the possibility of such damages. Our total liability for any claim arising out of or relating to the Site is limited to the greater of the amounts you paid to us through the Site in the twelve (12) months before the event giving rise to the claim, or one hundred dollars ($100).

These limitations do not apply to liability that cannot be limited under applicable law, and they do not modify the liability provisions of the Rental Agreement, which govern claims relating to your stored property and the storage relationship.

11. Indemnification

You agree to indemnify and hold harmless Red Magic Storage and its members, managers, employees, and service providers from any claims, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your misuse of the Site, your violation of these Terms, or your violation of any law or the rights of a third party.

12. Changes to the Site and these Terms

We may modify or discontinue any part of the Site at any time. We may also update these Terms; if we make material changes, we will post the updated Terms with a new effective date and, where appropriate, notify you. Your continued use of the Site after the effective date means you accept the updated Terms.

13. Termination

You may stop using the Site at any time. We may suspend or terminate your access to the Site if you violate these Terms or if we discontinue the Site. Termination of Site access does not by itself end your storage rental or your payment obligations, which are governed by the Rental Agreement.

14. Governing law and venue

These Terms are governed by the laws of the State of South Dakota, without regard to its conflict-of-laws rules. You and Red Magic Storage agree that any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in or serving Yankton County, South Dakota, and you consent to the personal jurisdiction of those courts. There is no agreement to arbitrate disputes.

15. General

These Terms, together with the Privacy Policy (and, for your storage rental, the Rental Agreement and Facility Rules), are the entire agreement between you and Red Magic Storage regarding the Site. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. We are not liable for delays or failures caused by events beyond our reasonable control. Notices to you may be sent to the email address on your account; notices to us should be sent to info@redmagicstorage.com.
